Yesterday, Juicy Couture filed a lawsuit accusing Victoria's Secret Pink of using similar ideas and icons, such as their trademark seat-of-the-pants Juicy logo (below). Also underscored was the fact that Victoria's Secret is selling apparel wrapped in the shape of lollipops and ice cream cones, mimicking the packaging used in Juicy's Sweet Shoppe.
The suit claims that Victoria's Secret is trying to capitalize on the success of Juicy Couture, which raked in a whopping $420 million in sales last year. The company is asking for the offending clothing to be destroyed and to be awarded triple damages. Victoria's Secret has made no comment, but do you think the lawsuit has merit?

1this is ridiculous.. walmart does this to their pants now. i think juicy is just a bunch of whiny b*tches.. they seem to be doing fine with sales, so no need to try to bring down VS. they're stuff is at least affordable.
2This happens all the time in fashion. Louis Vuitton sued Dooney and Bourke for use of initial prints... as far as I know the case has been pending for 4 year. These cases usually end up settled because it is so hard to prove that a company is directly infrigeing on a trademark. All fashion is influenced by each other, its silly to think that a look occurs in a vacuum. Besides, the girls who care enough to buy a juicy sweatsuit probably wouldnt consider the VC version, and I doubt girls who buy the VC sweats would spring for the juicy ones, so who cares?

You could get a sweat suit at wal mart since like forever just like that with stuff written on your butt if you wanted. i think they are only doing this because Vicotira's Secret may have a very similar market and is cutting into their profit margin. This idea is hardly original so they should just get over it.
10i've been waiting for this for years! pink is just a low-rent juicy. the reason i hate pink is because it's an entire brand that is a knock-off. i know the whole sweatsuit thing has been overdone for a while now, and has been done by a million different companies, but all of pink is a knockoff. the brand was produced to be a knockoff!!! lame!

12i think that, if anything, juicy could have a weak dilution claim against victoria's secret, but nothing else. there's certainly no trademark infringement, and they could try for a common law unfair competition claim, but it's been going on for so long that they'd have a hard time of it! it will be interesting to see what comes of this, though . . .
13I completely agree bananapancake--with intellectual property suits you usually need a showing of HARM, and since Juicy and VS are marketing to different kinds of consumers, it's going to be tough for Juicy to show that. Juicy seems to be making the claim that the harm is much broader in that VS is copying the whole "essence" of what Juicy is/stands for, but I'd be surprised if a court would buy that.

I'm wearing sweat pants from Aeropostale right now..and they have that written across the butt. Tons of companies are doing this now. Such is life.
Plus, as someone mentioned school have been doing this forever. Also, touristy places like on the Jersey Shore have always had sweat pants with stuff like "life guard" or the places name on the back.

18Juicy Couture is not marketed towards teenagers. Victoria Secrets Pink seems to be marketed towards the college set...the ads are very "dormitory" styled. Juicy seems to be marketed towards women in their mid-twenties to early thirties...just beginning a career and still in that "prime of youthful life" mode.
19I agree with whoever said that the bigger issue is that all of those sweatpants are hideous. I don't know if the lawsuit has any merit, but obviously lots of companies are doing that, and I personally wish it would go away. I don't really care to have words, whether it be "pink" or "juicy", emblazoned on my ass.
20juicy sweatsuits were popular years ago, they've kind of faded and i feel like only fashion victim-types buy them now...maybe they are just upset bc sales for them are down? no idea.
some of juicy's actual clothes are super cute, but their sweatsuits are for people who are just want to buy a name, not fashion
21considering that Juicy clearly stole the idea from colleges, who've been doing the name on the butt thing forever, the suit has no merit whatsoever. It's like Phat's suit against VS for using the emblem. Right cause Phat was the first brand to ever use an emblem. The truth is that all these blands took typical collegiate wear and marked it up. None of these suits deserve any merit.
22I happen to like the Pink stuff, but like the Juicy stuff I own, I would NEVER wear it out in public. I cannot stand that it has become a trendy form of dressing. I think the only time I ever wore even my Juicy sweatshirt out was to board a plane overseas.

23Similar? Wow then there are many companies that should be suing Juicy because they weren't the first company to use the butt as and advertising space. Secondly the use of the word Couture for some of the crap they make...well real Corture designers should be suing them. There is nothing one of a kind about them. I've never worn there junk anyway and this is just one more reason not too!

31Plus, the word couture means that a clothing item is specially made for you and have different sewing seams then most other clothing. Juicy Couture doesn't do this, so there is nothing couture about them besides their high prices!

44I suppose if you're rolling in money and can afford Juicy you would be for this suit, but as for us average, broke 20-somethings, VS let s us buy cute stuff and not pay a month's rent for it. I love the PINK line, and not because it looks like Juicy...but because it's comfy and cute. Words are on the butt of pants at Wal-Mart, sorority girls have pants with their letters on them, High School cheerleaders wear them with their team name on them...this suit is about 4 years too late. It's a young look and yes, once you're a certain age you look stupid wearing these in public. IMO wearing sweats in public is inappropriate past high school, anyway.
45This is so redic! I can't believe they are wasting their time with this. VS pants are much cuter, and the idea of "Juicy" written on the back of pants worn by 12 year old girls in middle school is appalling. Juicy should stop making them, period.
